Terms and Conditions of entry in the Sun Bum ‘Banana Suit Challenge’ (the Promotion)

1. Eligibility: NO PURCHASE NECESSARY TO ENTER OR WIN.

The Promotion is open to everyone aged 13 and older, around the globe – but you will need an Instagram account and a (half reliable) internet service to participate. Employees, officers and directors of Sun Bum, subsidiaries, and affiliated companies, advertising, promotion, or production agencies, web masters/suppliers and their IRS dependents and immediate family members (spouse, parents, children, siblings) can participate but are not eligible to win. By entering the Promotion, entrants fully and unconditionally agree to be bound by these Terms and Conditions. Void where prohibited, taxed or restricted by law. All federal, state, provincial and local laws and regulations apply.

2. Timing: The Banana Suit Challenge competition (the “Promotion”) begins on 1 May 2019 and ends at 11:59pm PT on 31 May 2019 (the “Promotion Period”). There will be weekly draws, and the winner(s) of each weekly draw will be submitted to a final draw at conclusion of the Promotion Period.

3.How to Enter: Super easy – post on your Instagram account a photograph or video clip of featuring you or someone you know wearing a banana suit, along with our “Know Your Spots” infographic, using your user profile and using the hashtag #bananasuitchallenge and #trustthebum. You will need to check your user profile is marked public.

Please note that all entries must feature BOTH someone in a banana suit and the “Know Your Spots” infographic.  It can be posted together as a carousel or as two separate posts to the Instagram grid.

Submissions that we consider to be obscene, inappropriate or offensive will be disqualified from entry and reported to Instagram. Submissions must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights or that constitutes copyright infringement.

There is no restriction on the number of separate entries you can submit during the Promotion Period.

Sun Bum retains the sole discretion as to who is selected as a weekly winner(s) and the Grand Prize winner for the Promotion. The finalists will be notified after the Promotion Period, and the Grand Prize will be awarded on 4 June 2019.

4. Prizes: Sun Bum will select up to one photo and/or video each week during the Promotion Period. The weekly winner will be awarded a love pack (valued at $50USD retail) and winners will be posted and notified (by DM). These weekly winners will then become finalists in the Grand Prize draw at the end of the Promotion Period. The Grand Prize is one of each product we make in our personal care line (retail value of over $1,000 USD for one of each of our products in our USA range of hair, lip, baby and sun care products), along with a Golden Banana.

Any prizes awarded in the Banana Suit Challenge contest are non-transferable and no substitution will be made except as otherwise at Sun Bum’s sole discretion.

Winners are responsible for all international (outside contiguous USA) duties, taxes, or fees associated with receiving a prize. Sun Bum will cover direct shipping expenses. All federal, state, local and other tax obligations arising from this Promotion, including, without limitation, winning a prize, will be the sole responsibility of the prize winner.

Winners will be notified on Sun Bum’s Instagram page and/or notified individually via DM.

5. Consent: Please note all entries become the sole and exclusive property of Sun Bum and by submitting a photograph you are consenting to use of the photograph and your Instagram user name in print or electronic media by Sun Bum and its affiliates. Entrants further acknowledge and agree to Sun Bum’s collection and usage of their personal information for use in administering the Promotion and have read and accepted Sun Bum’s privacy policy (available here https://www.trustthebum.com/pages/privacy-policy). Unless the entrant otherwise expressly agrees, his/her personal information shall be used only for the purposes of administering the Promotion.

6. General: All federal, state and local rules and regulations apply. By receipt of any prize, winners agree to the use of their name, Instagram user name, and the winning photograph for purposes of advertising, trade or promotion without further notice or compensation except where prohibited by law. By participating in the Promotion, or by accepting a prize, all participants agree to release, indemnify, and hold harmless Sun Bum and Instagram for any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including, without limitation, property damage, personal injury and/or death which may occur in connection with the Promotion, or possession, acceptance, and or use or misuse of any prize or participation in any Promotion-related activity and claims based on publicity rights, copyright infringement, trademark infringement, intellectual property rights, defamation or invasion of privacy. Further the Entrant acknowledges that Sun Bum have no obligation to use or post any Submission.

You also acknowledge that this Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram.

This Promotion is otherwise governed by the laws of the United States and the State of California applicable to contracts made and performed in the State of California.
